A man who police gave a ride to the Budget Inn after they discovered him sleeping on a sidewalk, eventually was tased after he allegedly struggled with officers in a dispute over buying a beer.
According to Madison Police Department reports, Marcus Shondarious Hurt, 37, Milledgeville, was arrested and charged with obstruction, criminal trespass, disorderly conduct and public drunkenness on Friday, Aug. 13. Reports state that at approximately 11 a.m., an officer responded to a complaint of a man sleeping on the sidewalk in front of Hibbett’s Sports, Eatonton Road.
When the officer arrived, he allegedly observed Hurt sleeping on his back with an open and half-filled liquor bottle next to him. Reports state the officer woke Hurt and told him he had to go somewhere else or he would be in violation of Madison’s public intoxication ordinance. Hurt requested a ride to the Budget Inn and the officer agreed and dropped him off at 11:30 a.m.
Less than 10 minutes later, a clerk at the Sunflower Convenience Store, which is located next door to the Budget Inn, called and reported that Hurt had entered the store after he had been served with a criminal trespass notice at the store previously.
An officer located Hurt at the back of the store seated in a chair drinking a beer. The officer informed Hurt that he had violated a criminal trespass order and was now under arrest. Hurt eventually stood, reports state, and an officer told him he would allow him to be cuffed on the front for comfort if he would cooperate.
However, reports state, when the officer attempted to apply the handcuffs, Hurt resisted and a physical struggle between Hurt and four officers ensued. An officer drew a taser weapon and Hurt raised his arms, but then started resisting again, breaking one officer’s glasses. The officer deployed the taser weapon and after a five-second cycle Hurt was secured in handcuffs.
The officer later learned that Hurt had entered the store, tossed $1.17 on the counter and took a 24-ounce beer from the cooler while the clerk was trying to make Hurt leave.
